1. Agreement to Terms

By accessing and using TestimonySong ("the Service," "we," "us," or "our"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this Service.

2. Description of Service

TestimonySong creates custom, personalized Christian songs based on the stories, testimonies, and information you provide. Each song is uniquely created for you by our team of songwriters and producers, and delivered digitally.

3. Eligibility

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Account and Registration

While account registration is not required to place an order, you are responsible for:

• Providing accurate and complete information when placing an order
• Maintaining the confidentiality of any order confirmation or access links
• All activities that occur under your order

5. Pricing and Payment

Current pricing for TestimonySong services:

• Standard Song: $99 USD (delivery within 5 days)
• Rush Delivery: Additional $140 USD (delivery within 24 hours)
• Printed Lyrics: Additional $29 USD

All payments are processed securely through Stripe. Prices are subject to change without prior notice, but changes will not affect orders already placed and paid for.

6. Delivery

Digital delivery is considered complete when the song access link is made available and an email notification is sent to the address you provided. We are not responsible for:

• Incorrect email addresses provided by you
• Emails filtered to spam or junk folders
• Technical issues on your end preventing access
• Failure to download the song within the 7-day access window

Important: Song streaming links expire after 7 days. You must download your MP3 file within this period to retain permanent access.

7. Refund Policy

We offer a 7-day money-back guarantee under the following conditions:

• Refund requests must be submitted within 7 days of song delivery
• Contact us at hello@testimonysong.com with your order details
• Refunds are processed within 5-10 business days to the original payment method

The refund guarantee is voided if:

• You download the MP3 file (downloading signifies acceptance of the final product)
• More than 7 days have passed since delivery
• The order was for rush delivery and production has begun

You may listen to your song on our web player without voiding the guarantee. Add-on services such as rush delivery and lyrics are non-refundable once purchased.

8. Intellectual Property and Licensing

Your License: Upon full payment, you receive a personal, non-exclusive, non-transferable license to:

• Listen to and enjoy your song for personal use
• Share the song at personal events, family gatherings, and church services
• Post the song on personal social media accounts
• Gift the song to the intended recipient

Prohibited Uses: You may NOT:

• Sell, resell, or commercially distribute the song
• Use the song in commercial advertisements or products
• Claim ownership or authorship of the song
• Upload the song to music streaming platforms (Spotify, Apple Music, etc.)
• Modify, remix, or create derivative works from the song

Our Rights: TestimonySong retains ownership of all musical compositions, arrangements, and recordings. We reserve the right to use anonymized versions of songs for portfolio, promotional, or sample purposes.

9. User Content and Submissions

When you submit stories, testimonies, feedback, video testimonials, or other content ("User Content") to TestimonySong, you grant us a perpetual, worldwide, non-exclusive, royalty-free license to use, reproduce, modify, publish, and distribute such content for:

• Creating your custom song
• Marketing and promotional purposes (testimonials, case studies)
• Improving our services
• Any other lawful purpose

For video testimonials and media submissions, please refer to our separate Media Release Agreement.

10. Content Guidelines

You agree that all content you provide will be:

• Truthful and accurate to the best of your knowledge
• Respectful and appropriate for a Christian context
• Free from hate speech, obscenity, or illegal content
• Not infringing on any third party's rights

We reserve the right to refuse service for any content that violates these guidelines, without refund.

11. Referral Program

Our referral program is subject to the following terms:

• Referral discounts apply to new customers only
• Self-referrals are prohibited and will be voided
• Maximum of 5 successful referrals per customer
• We reserve the right to modify or discontinue the referral program at any time
• Referral credits cannot be combined with other promotions unless specified

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will meet your specific requirements
• The Service will be uninterrupted, timely, secure, or error-free
• The results from using the Service will be accurate or reliable
• Any errors will be corrected

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TESTIMONYSONG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

14. Indemnification

You agree to indemnify, defend, and hold harmless TestimonySong and its officers, directors, employees, agents, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit to the Service

15. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, with arbitration taking place in Delaware, USA.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

18. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
